Terms & Conditions

These terms govern our website, systems, and automation services.

ReachDesign Terms of Service apply to all website, system, and automation services provided by ReachDesign Ltd (“we”, “us”, “our”) to the client (“you”, “your”). By accepting a quote or using our services, you agree to these Terms of Service.

1. Acceptance

It is not necessary for you to sign these terms for them to apply. When you accept a quote from us, you confirm that you have read, understood, and accepted these terms in full. We may update these Terms of Service from time to time by posting the revised version on our website.

2. Payments

  • All projects require a 50% non-refundable deposit before work begins.
  • The remaining balance is due when the work is completed to a reasonable standard.
  • Hosting, domain, or additional feature fees may change each year; these will be invoiced 14 days before the due date.
  • If your project is delayed because we have not received required content from you, the remaining balance will still be invoiced within 70 days of the project start date.

3. Approval of Work

  • On completion, we will notify you so you can review the work.
  • Revisions must be requested in writing within 7 days of notification.
  • We are happy to make revisions, but may limit the number of changes to those agreed in your project scope. Extras outside scope may be charged at our current hourly rate.

4. Hosting and Domain Name

  • Our websites are hosted on third-party platforms. You agree to follow the terms and conditions set out by those providers (links available on request).
  • You are legally responsible for the use of your domain name and hosting services.
  • We are not liable for issues, downtime, or losses caused by third-party providers.

5. Content

You must ensure that all text, images, logos, trademarks, and any other material you provide are free to use without breaching copyright or other rights. You take full responsibility for securing the necessary permissions for all content supplied to us.

6. Ownership

  • Once final payment has been received, ownership of the website and associated content we have created for you transfers to you.
  • Responsibility for managing your domain, hosting, and any associated accounts also transfers to you at that point.

7. Maintenance

  • We offer maintenance and update services by agreement.
  • Updates or changes outside the original project scope will be quoted and charged at our current hourly rate.
  • If you have a signed website development agreement, any support clauses in that agreement will also apply.

8. Termination

  • Either party may terminate this agreement by giving written notice.
  • If you wish to cancel web hosting or change providers, send us a cancellation request at least 10 days before your next billing cycle to avoid charges for the following term.

9. Liability

We will not be liable for any indirect, incidental, special, consequential, or punitive damages, including (but not limited to) loss of profits, data, goodwill, or other intangible losses resulting from:

  • Your access to, or inability to access, our services.
  • Any third-party conduct or content on the service.
  • Content obtained through the service.
  • Unauthorised access, use, or alteration of your data or transmissions.

10. Privacy Statement

We collect personal information from you including:

  • Name and contact information
  • Computer or network information
  • Interactions with us
  • Billing or purchase information

We collect this information to:

  • Provide and manage our services
  • Allow you to access your account and receive updates

We may share this information with:

  • Our hosting/domain suppliers and selected contractors for the purpose of developing, updating, and registering websites and automation services.

11. Koha Services

  • Koha Sessions are designed to provide affordable, practical support for small to medium businesses.
  • Minimum koha is $34+GST per hour, payable upfront.
  • You may choose to contribute more based on the value you receive.
  • Koha fees are non-refundable but sessions can be rescheduled (up to three times) with at least 12 hours’ notice.
  • Feedback is encouraged to help us improve our services.
